Who we are
This policy covers OzCap Finance Pty Ltd (ABN 75 682 074 826, ACN 682 074 826), trading as OzCap Finance. Jonmarco Sanchez is an Authorised Credit Representative (Number 565450) of AFAS Group Pty Ltd (ABN 12 134 138 686, Australian Credit Licence 414426). We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).
What we collect
What you give us. When you contact us through this website, by phone, text message, email or WhatsApp, we collect your name, business name, phone number, email address, what you are looking to finance, and anything else you tell us. If you go ahead with an application, we collect the further financial and identity information a lender needs to assess it. We collect that directly from you by phone or email, not through the website form.
Text messages and calculators. The "Text Marco" buttons open your own messaging app with a message already typed. Nothing is sent to us until you press send, and your message and mobile number then travel over your phone provider's network. We may reply by text. The calculators work out their results in your browser, and the figures you type are not sent to us. They only reach us if you choose to text or call us with them.
What we collect automatically. When you send an enquiry through the form, we record the date and time and your IP address, which we use to prevent spam and abuse. When you browse the site, Google Analytics collects information about how the site is used, such as the pages you view, your approximate location, your device and browser, and how you found us. It does this using cookies (see below).
How we use it
We use your information to:
- respond to your enquiry and assess your finance needs;
- where you ask us to, prepare and submit applications to lenders on our panel;
- keep the records we must keep as a credit representative;
- keep this website secure and prevent spam; and
- understand how the website is used so we can improve it.
We do not sell your information. We only send you our newsletter or other marketing emails if you tick the optional newsletter box on our contact form or otherwise ask us to. Ticking it is never a condition of getting a reply, we keep a record of when you ticked it, and every email includes a way to unsubscribe. You can also unsubscribe at any time by emailing marco@ozcap.com.au. We do not use Google Analytics advertising features or remarketing.
Who we share it with
- Lenders on our panel. To arrange finance, we share the relevant information with lenders and, where needed, the aggregator that gives us access to them.
- AFAS Group Pty Ltd, our credit licensee, which may access our records to supervise our credit activities and meet its compliance obligations.
- Credit reporting bodies. If you ask us to, and authorise it, we can request a credit report about you from a credit reporting body to help us assess an application. To do that we disclose your identification details to that body. Lenders may also obtain credit reports themselves when they assess an application. You can ask a credit reporting body not to use your information for direct marketing pre-screening, or not to release it if you believe you are a victim of fraud.
- Service providers that run this website:
- Cloudflare, Inc. hosts this website, runs the enquiry form, stores enquiry submissions and provides the Turnstile check that confirms a form is sent by a person.
- Resend delivers the email notification of your enquiry to us.
- Google LLC provides Google Analytics.
- Anyone else only where the law requires it.
Overseas disclosure
Our website service providers operate globally, and your information may be processed by them in the United States and other countries. We take reasonable steps to make sure they handle your information in a way that is consistent with the Australian Privacy Principles. Lenders on our panel may also be located, or use service providers, overseas. We will tell you if that affects an application.
Cookies and analytics
Google Analytics sets cookies in your browser to tell visitors and visits apart. The information collected is used in aggregate and is transmitted to Google. You can block or delete cookies in your browser settings, or install the Google Analytics opt-out browser add-on. The contact page and the homepage enquiry form also load Cloudflare Turnstile, which uses technical signals such as your IP address and browser details to check that a submission is from a person.
If you message us on WhatsApp, WhatsApp’s own privacy policy applies to that conversation. Links from this site to other websites, including social media, are subject to those sites’ own policies.
Where it is stored and how long we keep it
Enquiries sent through the website are stored in a database hosted by Cloudflare and copied to us by email. We keep records of enquiries and applications for as long as we need them for the purposes above and to meet the record-keeping obligations that apply to credit representatives, which is generally 7 years. After that we securely delete or de-identify them.
Security
This website uses encryption in transit (HTTPS), the enquiry form is protected against spam and abuse, and access to enquiry information is limited to Marco, the people who maintain this website and, where required, AFAS Group. No online system is completely secure, so please do not send identity documents or bank statements through the contact form. When we are in touch we will tell you the safest way to send them.
Your rights
You can ask for access to, or correction of, the personal information we hold about you, ask us to delete it where we are allowed to, or opt out of marketing at any time by contacting us at marco@ozcap.com.au. We will respond within 30 days.
Complaints
If you think we have mishandled your personal information or otherwise not done the right thing, please contact us first on 0481 013 126 or marco@ozcap.com.au so we can try to fix it. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner about a privacy matter, or to the Australian Financial Complaints Authority (AFCA, 1800 931 678) about our credit activities. Changes
We may update this policy from time to time as our services, our obligations or the law change. The current version is always the one published here, with the date it was last updated at the top.
